1. The Green Cemetery, created by a Trust under Will of Dr. Lewis M. Green in 1894, is under the care, custody and control of the Trustees (hereafter also “the cemetery”) appointed by the Surrogate Court of Gloucester County. The NJ Cemetery Board, under N.J.S.A 45:27 and NJAC 13:44(J) shall be deemed authority in the event of a conflict in regulations or the absents of a specific rule, as may be required.
2. The cemetery hereby expressly reserves the right at any time, with or without advance notice to all lot owners, to adopt new rules and regulations or to amend alder and/or repeal any rule, regulation, and/or article, section or paragraph of these rules and regulations.
3. Official notices and all matters of public record will be posted & removed from the bulletin board only by order of the trustees.
4. Special cases may arise in which literal enforcement of the rule may impose unnecessary hardship; and accordingly, the cemetery therefore reserves the right, without notice, to make exceptions, suspensions or modifications of any of the rules or regulations, when in its judgment, the same appear advisable, and search temporary exception, suspensions or modifications shall in no way be construed as affecting the general application of such.
5. The cemetery retains to itself, for the benefit of all internment right owners, full and complete supervision, control and management of the land, buildings, improvements, roads, walks, utilities, development, books and records, and a full complete authority, rights and privileges to make, change, administer and enforce rules and regulations which are not inconsistent with the laws of the State of New Jersey.
6. Damage or vandalism to the cemetery (i.e., property, buildings, fencing etc.) shall be promptly documented and reported to local Police for potential criminal prosecution.
7. Access to the Cemetery is only via the (north-west) main gate from Tanyard Road.
8. Any person found within the cemetery between Dusk and Dawn will be considered a trespasser and reported to local Police, as will any “identified criminal activities”.
9. Automobile parking (day or overnight) - except for: bonified easement holders, funerals, memorial visits and official business - is prohibited; and may be subject to punitive enforcement.
10. Assemblages within the Cemetery except for funerals, remembrances and official cemetery business or activities is prohibited per N.J.S.A 45:27-19(b)(4).
11. Unaccompanied minor children are prohibited - the cemetery is not a playground.
12. Dogs are not permitted except when kept on a leash or in a vehicle; and owners must clean-up after their animals.
13. The trustees shall cause to be removed and or permanently bar, any person or persons found to be disruptive or disorderly with the cemetery.
14. The trustees shall, to a reasonable extent, maintain the facility - absent an event of "Force Majeure" which is beyond their reasonable control.
15. Lots must be paid in full before any internment is made. Monument fees must be paid in full, before said monument is installed. At least 1 week’s advance notice of funeral services and monument placement is required. ALL SALES ARE FINAL.
16. The cemetery will have the right to enter upon or use any adjoining lot or lots in order to carry out its duties as to an adjacent internment without notice of lot owners.
17. In keeping with Dr Green’s vision for the Cemetery and given the rustic nature of this facility; and in order to prevent soil erosion, damage caused by fallen trees (or by tree branches), and avoiding personal injury; all visitors (except easement holders, cemetery officials and their formally designated agents / vendors) and any associated vehicles (mechanized or otherwise) shall be prohibited from entering the grounds of the Green Cemetery (except for previously scheduled funerals) for the following periods:
a. 1 day: after a rain, ice or snow fall of less than 1 inch
b. 2 days: after a severe rain storm, wind storm or an ice storm[1]
c. 3 days: after a Hurricane, or Blizzard / Snow Storm[2] of more than 1 inch
In order to protect property and prevent personal injury – the Trustees may farther restrict Cemetery access due to post-storm damage restoration or other temporary maintenance activities, having given advance public notice of these pending activities.
18. The Sexton(s) may remove unsightly flowers / decorations / flags at direction of trustees.
19. The cemetery shall direct all improvements within the grounds and upon all lots before and after interments have been made herein.
20. The cemetery will take all reasonable precautions to protect lot owners and their property within the cemetery from loss, damage or injury however, given the rustic nature of the facility - it shall not be responsible for any loss, or damage, or injury.
21. The cemetery will issue a formal deed to each owner which signifies only “ownership” and the right of interment, but no other powers or privileges. A deed naming more than one owner is indicative of joint ownership in common with rights of survivorship (or as otherwise provided under N.J.S.A 45:27-28(c) etal).
22. All lots are sold in accordance with the provisions of N.J.S.A 45:27 etal and shall ONLY BE UTILIZED FOR THE INTERNMENT OF HUMAN REMAINS as provided in the ownership deed.
23. Activities are restricted and no new sales shall be made within the designated “historical Sections” of the cemetery i.e., Section - K (Eastern Annex) and West Park A and West Park B.
24. Landscaping the facility is the sole responsibly of cemetery; however individual plots owners are free to tend their plots as needed; subject to the regulations and limitations herein. No person shall be allowed to perform any work – other than ordinary remembrances (i.e., flowers, wreaths, etc.) - within the cemetery without written permission from the cemetery’s trustees. Remembrances shall be removed by cemetery officials, when they become derelict or otherwise dilapidated. Damaged American Flags shall be properly retired, as appropriate.
25. Rules and regulations of the cemetery and the prices for burial spaces and services are made by the cemetery and become effective upon the approval of the NJCB.
26. Lot owners are prohibited from allowing internments to be made on their lots for compensation; however, plots may be resold with the approval of the Trustees and a formal deed transfer.
27. Bringing alcohol or illegal drugs into the cemetery facility is strictly prohibited.
28. No signs, notices, or advertisements of any kind shall be allowed within the cemetery; other than those so approved by the Trustees.
29. All Firearms and Weapons are prohibited within the cemetery facility except for law enforcement agents and any military honor guards who are present at funerals or remembrances. Hunting and trapping within cemetery facility is strictly prohibited.
30. In addition to any formal posting on the bulletin board (see 3); the trustees may also post relevant information on the cemetery’s website which is known as: https://www.historic-green-cemetery-nj.org or such other publicly available technology as may be appropriate into the future.
